What To Do After an Accident: Types of Personal Injury Cases in South Carolina

South Carolina follows a fault-based system for car accidents, meaning the at-fault driver is responsible for damages caused by the crash. If you are injured, you may be entitled to compensation for medical expenses, lost wages, property damage, and pain and suffering. However, insurance companies often try to minimize payouts or shift blame to reduce what they owe.


It is important to:


  • Document the scene: Take Photos


  • Seek immediate medical attention


  • Avoid giving recorded statements without legal guidance


South Carolina also follows a modified comparative negligence rule, which means your recovery can be reduced if you are partially at fault—and barred entirely if you are more than 50% responsible. Taking prompt action and getting legal advice early can make a significant difference in the outcome of your case.


Workplace Injuries:


Most employers in South Carolina are required to carry workers’ compensation insurance. If you’re hurt on the job, you may be entitled to medical care, wage replacement, and other benefits – even if the accident was partly your fault.

  • “Notice” means telling your employer the injury happened, that it was work-related, and roughly when it occurred—preferably in writing to prevent disputes.


  • Delaying your report can jeopardize benefits like medical care and wage replacement, and may lead to disputes before the South Carolina Workers’ Compensation Commission.


  • Separate from notice, you must file a formal workers’ compensation claim within 2 years, or you may lose your right to benefits entirely.



Slip-and-Fall Incidents: 


South Carolina follows premises liability laws, which hold businesses responsible for maintaining reasonably safe conditions.


Hazards like wet floors, uneven pavement, or flooring defects can make the property owner liable if they cause injury.


If you are hurt from a slip and fall:


  • Take photos of the dangerous condition


  • Get witness information


  • File an Incident report immediately


These steps are critical in proving negligence.


Dog Bites and Animal Attacks:


South Carolina law holds dog owners strictly liable for injuries their animals cause, even if the dog has no prior history of aggression. Timely action is critical, as there are specific notice requirements and time limits for filing a claim. Prompt legal guidance helps protect your right to compensation for medical bills, pain and suffering, and other damages.



In South Carolina, most personal injury claims are subject to a 3-year statute of limitations, while workers’ compensation claims generally must be filed within 2 years; regardless of the type of claim, you should report the injury, seek medical treatment, and document everything as soon as possible to protect your rights and strengthen your case, and consulting an attorney early can help ensure deadlines are met and maximize your chances of a successful outcome.
